How to participate in the Sweepstakes

The prize: The winner will receive one (1) Elliptical Machine of a value equivalent to 349.99 US Dollars
Eligibility: “Subscribe & Win ” (“Sweepstakes”) is open only to legal residents of the United States; and age 21 or older.
Not eligible for the Sweepstakes: Employees and directors of RackToDoor.com (“Sponsor”), their respective parents, subsidiaries, affiliated companies, and advertising, promotion, or production agencies associated with this offering (and the dependents, immediate family members, and individuals residing in the same household as any of the foregoing persons) are not eligible.
All applicable federal, state, provincial, and local laws apply.
By participating, you agree to be bound by these Official Rules (“Rules”). Void where prohibited.
Entry Period: December 6, 2022, at 9:00:01 a.m. Pacific Time (“PT”) through February 28, 2023, at 11:59:59 p.m. PT (the “Sweepstakes Period”).
Selection of Winner: On January 10th and February 10th, 2023, one (1) Participant will be selected at random (the “Draw”) from among all participant accounts that entered the Sweepstakes during the Sweepstakes Period. The potential winner will be notified using the contact information supplied at the time of entry. No liability is assumed for any winner notification lost, intercepted, or not received by a potential winner for any reason. Suppose the winner is unable or unwilling to accept the prize. In that case, he/she will be disqualified, and the prize forfeited, and, in such an event, an alternate winner will be selected from the remaining eligible entries. Failure to respond to any winner notification within two (2) business days may result in disqualification and selection of an alternate winner. If the potential winner is found to be ineligible, or if he or she has not complied with these Official Rules or declines a prize for any reason prior to award, such potential winner will be disqualified and an alternate winner may be selected. By entering this Sweepstakes, all entrants agree that the Sponsor has the sole right to decide all matters and disputes arising from the Sweepstakes and its determination of the winner is final. The sponsor reserves the right to require proof of identification, age, eligibility, and acceptance of these Official Rules from any potential winner before awarding a prize.
Prize/Odds: On January 10th and February 10th, 2023, One (1) winner will be awarded One (1) free Elliptical Machine. The total Approximate Retail Value (“ARV”) of the Grand Prize is $349.99. Winners will be selected at random from qualifying entries. The winner will be contacted via their email submission to subscribe to RackToDoor.com Newsletter List and asked for more information to coordinate prize delivery. Shipping to the winner at a continental US location only, per contest rules.
RESTRICTIONS: There is no substitution for any prize or any portion thereof except at the sole discretion of the Sponsor. Sponsor may substitute a prize of comparable value if an advertised prize or any portion thereof becomes unavailable. The prize is not transferable, assignable, or redeemable for cash. Any difference between advertised and actual values will not be awarded. The winner is responsible for any and all federal, state, and local taxes and any expenses or costs related to the prize not expressly set forth above.
GENERAL TERMS/CONDITIONS: If a potential winner or potential guest has engaged in or does engage in any conduct that could damage the reputation or business of any sponsor, as determined by the Sponsor at its discretion, the potential winner may be disqualified and the prize may be awarded to an alternate winner, time permitting.
The Prize must be accepted as awarded and cannot be transferred or exchanged for cash. No substitution of the Prize is permitted, except at the sole discretion of the Sponsor. The Sponsor may replace the Prize, or any part of the Prize, with another prize of equal or greater value. Any portion of the Prize not accepted by the Winner will be forfeited. The Sponsor cannot be held responsible if an event leads to the cancellation of the Contest, or if other factors reasonably out of the Sponsor’s control prevent the Contest or any part of the Contest from being completed. The Sponsor gives no warranty of any kind, express or implied, concerning the safety, appearance, or performance of the Prize. In accepting the Prize, the Winner recognizes that the only applicable warranties to any part of the Prize, as the case may be, are the warranties provided by the supplier of the Prize to the Sponsor that are transferable and/or the manufacturer’s warranty. No Winner will have any recourse against the Sponsor with regards to any aspect related to the Prize or Contest in any circumstance whatsoever. A Winner has no right to the difference between the actual Prize value and the approximate Prize value stated in these rules if any difference exists. Any attempt to damage The RackToDoor.com website, the social media pages of The RackToDoor.com Contest, or undermine the legitimate operation of this Contest constitutes a violation of criminal and civil law. Should such a case occur, the Sponsor reserves the right to seek damages and remedies to the fullest extent permitted by law, including criminal prosecution. No correspondence will be entered into regarding this Contest, except with each Selected Participant and each Winner.
Each potential winner and potential guest must also comply with all requirements for proper and appropriate behavior during any prize-related activities or events. Any inappropriate behavior, as determined by the Sponsor in its sole discretion, may result in removal from any activity or event. By accepting the prize, the winner grants the Sponsor the right to use and publish the winner’s proper name, Instagram/Facebook/Twitter name, likeness, persona, hometown, and/or prize information in all media now known or later devised throughout the universe in perpetuity for all purposes Sponsor deems appropriate - including, without limitation, for promotional and publicity purposes - without further permission or compensation. As a condition of being awarded any prize, except where prohibited by law, the winner may (at Sponsor's sole discretion) be required to execute a written consent, confirming the Sponsor’s right to use such winner’s name, Instagram/Facebook/Twitter name, likeness, persona, hometown, and/or prize information without further permission or compensation except where prohibited, and/or provide such additional information as reasonably requested by Sponsor. Decisions of the Sponsor are final in all matters relating to these Sweepstakes. By participating, entrants accept and agree to abide by and be bound by these Official Rules.
Indemnification by Participant: By entering you agree that Sponsor, RackToDoor.com, and their respective parents, subsidiaries, affiliates, advertising and promotion agencies, and all of their respective officers, directors, employees, shareholders, representatives, licensors, licensees, distributors, retailers and agents (collectively the "Released Parties") will have no liability whatsoever for, and you release and hold harmless the Released Parties for any liability for any injuries, losses or damages of any kind to persons, including death, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of or inability to use any prize or from participation or inability to participate in this Giveaway, including any Giveaway-related activity, and under no circumstances, including negligence, shall any of the Released Parties be liable for any direct, indirect, incidental, special or consequential damages resulting from participation in the Giveaway or acceptance, use or misuse of any prize
DISCLAIMER AND LIMITATION OF LIABILITY:
By entering you agree that: (a) No liability or responsibility is assumed by the Sponsor or Promotion Parties resulting from the user’s participation in, attempt to participate in, or download of any information in connection with participating in, the Contest. No responsibility or liability is assumed by the Sponsor or Promotion Parties for technical problems or technical malfunction, including, without limitation, those arising in connection with any of the following occurrences that may affect the operation of the Contest: hardware or software errors; faulty computer, telephone, cable, satellite, network, electronic, wireless, or Internet connectivity, or other online communication problems; errors or limitations of any Internet service providers, servers, hosts, or providers; garbled, jumbled, or faulty data transmissions; failure of any email transmissions to be sent to or received; lost, late, delayed, or intercepted email transmissions; inaccessibility of the website in whole or in part for any reason; traffic congestion on the Internet or web site; unauthorized human or non-human intervention in the operation of the Contest, including without limitation, unauthorized tampering, hacking, theft, virus, bug, worm; or destruction of any aspect of the Contest. Sponsor is not responsible for any typographical errors in the announcement of the prize or these Official Rules, or any inaccurate or incorrect data contained on the website. Use of web site is at the user’s own risk. Sponsor and the Promotion Parties are not responsible for any personal injury or property damage or any other losses of any kind that may be sustained to the user’s or any other person’s computer equipment resulting from participation in the Contest, use of the website, or the download of any information from the Web Site, or any other loss related to user’s participation in the Contest or receipt of any prize. As a condition of entering, entrants agree to release Sponsor, Promotion Parties, and Instagram/Facebook/Twitter from any and all liability, loss, or damage incurred with respect to the entrant’s participation in the Contest and the awarding, receipt, possession, and/or use or misuse of any prize. (b) Released Parties will have no liability whatsoever for failure to supply a prize or any part thereof, by reason of any acts of God, any severe weather, hurricane, flood, fire, war, transportation interruption of any kind, or any other cause beyond their control, (c) except where legally prohibited, winners grant permission for the Released Parties and those acting under their authority to use his/her name, and/or likeness, for advertising, trade and/or publicity purposes without additional compensation in all media now known or hereafter discovered, worldwide, including, without limitation, on the Internet, without notice, review or approval, (d) if any prize notification or prize is returned as non-deliverable, or if winner is found to be ineligible or not in compliance with these Rules, such prize will be forfeited and an alternate winner may be selected at Sponsor’s discretion, (e) noncompliance with any of the foregoing may result in disqualification and awarding of prize to an alternate winner as determined in the sole discretion of the Sponsor.
MISCELLANEOUS; GOVERNING LAW: The Promotion Terms and the RackToDoor.com Promotions are governed by US law and are subject to all applicable federal, state, and local laws and regulations. All issues and questions concerning the construction, validity, interpretation, and enforceability of the Promotion Official Rules, or the rights and obligations of Entrant and Sponsor in connection with RackToDoor.com. Promotion shall be governed by and construed in accordance with, the laws of the State/Commonwealth of California, U.S.A., without giving effect to the conflict of laws rules thereof, and any matters or proceedings which are not subject to arbitration
THIRD-PARTY SITES: Although this Sweepstakes will be relayed on Instagram/Facebook/Twitter via publications made using the accounts of The RackToDoor.com, the Sweepstakes is in no way sponsored, endorsed, or administered by, or associated with Instagram/Facebook/Twitter, nor is Instagram/Facebook/Twitter affiliated with the Sweepstakes. If entering the Sweepstakes by Instagram/Facebook/Twitter, All Participants recognize that in participating in the Sweepstakes they are providing their information to the Sponsor, and not to Instagram/Facebook/Twitter. Each Sweepstakes Participant releases Instagram/Facebook/Twitter from all responsibility. Any questions, comments, or complaints concerning the Sweepstakes must be addressed to the Sponsor of the Sweepstakes and not to Instagram/Facebook/Twitter. Entrants agree to comply with all respective terms and conditions of use by Instagram/Facebook/Twitter.
